Issues of Fact Exist as to Decedent’s Testamentary Capacity
If you thought this case was over, you didn’t carefully read the news from a couple of days ago. The same judge that found that the lawsuit against the hospital was filed too late is finding that there may be a question of whether Huguette Clark was fully mentally competent when she wrote the will.
The judge isn’t saying that Clark was not; she’s merely decided that the plaintiffs have produced enough questions about the issue so that they should have the judicial OK to bring forth whatever evidence they can produce to try to prove that Clark was not competent.
