{"id":20548,"date":"2014-06-18T19:28:25","date_gmt":"2014-06-18T23:28:25","guid":{"rendered":"http:\/\/sidebarforplaintiffs.naomifein.net\/?p=20548"},"modified":"2014-06-18T19:28:25","modified_gmt":"2014-06-18T23:28:25","slug":"global-war-against-women-a-subtle-reason-to-smile","status":"publish","type":"post","link":"https:\/\/sidebarforplaintiffs.naomifein.net\/?p=20548","title":{"rendered":"Global war against women: a subtle reason to smile"},"content":{"rendered":"<p>In yesterday&#8217;s New York Times, Adam Liptak&#8217;s Sidebar column told of an intriguing new study that has found &#8220;judges with daughters are more likely to vote in favor of women&#8217;s rights than ones with only sons.&#8221; <a href=\"http:\/\/www.nytimes.com\/2014\/06\/17\/us\/judges-with-daughters-more-often-rule-in-favor-of-womens-rights.html?module=Search&amp;mabReward=relbias%3Ar&amp;_r=0\">Another Factor Said to Sway Judges to Rule for Women\u2019s Rights: A Daughter &#8211; NYTimes.com<\/a>.<\/p>\n<p>It&#8217;s a fascinating article.\u00a0 It makes me grin. Here&#8217;s how it begins:<\/p>\n<p id=\"story-continues-1\" class=\"story-body-text story-content\" style=\"padding-left: 30px;\" data-para-count=\"96\" data-total-count=\"96\"><em>\u00a0WASHINGTON \u2014 It was, Justice Ruth Bader Ginsburg <a title=\"Times article\" href=\"http:\/\/www.nytimes.com\/2009\/07\/12\/magazine\/12ginsburg-t.html\">later said<\/a>, \u201csuch a delightful surprise.\u201d<\/em><\/p>\n<p class=\"story-body-text story-content\" style=\"padding-left: 30px;\" data-para-count=\"161\" data-total-count=\"257\"><em>In a 2003 Supreme Court opinion, Chief Justice William H. Rehnquist suddenly <a title=\"The case\" href=\"http:\/\/www.law.cornell.edu\/supct\/html\/01-1368.ZO.html\">turned into a feminist<\/a>, denouncing \u201cstereotypes about women\u2019s domestic roles.\u201d<\/em><\/p>\n<p class=\"story-body-text story-content\" style=\"padding-left: 30px;\" data-para-count=\"171\" data-total-count=\"428\"><em>Justice Ginsburg said the chief justice\u2019s \u201clife experience\u201d had played a part in the shift. One of his daughters was a recently divorced mother with a demanding job.<\/em><\/p>\n<p class=\"story-body-text story-content\" style=\"padding-left: 30px;\" data-para-count=\"139\" data-total-count=\"567\"><em>Justice Ginsburg\u2019s explanation in 2009, though <a title=\"Times article\" href=\"http:\/\/www.nytimes.com\/2003\/07\/06\/weekinreview\/ideas-trends-evolving-opinions-heartfelt-words-from-the-rehnquist-court.html\">widely accepted<\/a>, was but informed speculation. Now there is data to go with the intuition.<\/em><\/p>\n<p class=\"story-body-text story-content\" style=\"padding-left: 30px;\" data-para-count=\"252\" data-total-count=\"819\"><em>It turns out that judges with daughters are more likely to vote in favor of women\u2019s rights than ones with only sons. The effect, a <a title=\"The study\" href=\"http:\/\/scholar.harvard.edu\/msen\/publications\/identifying-judicial-empathy-does-having-daughters-cause-judges-rule-womens-issues\">new study<\/a> found, is most pronounced among male judges appointed by Republican presidents, like Chief Justice Rehnquist.<\/em><\/p>\n<p id=\"story-continues-4\" class=\"story-body-text story-content\" style=\"padding-left: 30px;\" data-para-count=\"193\" data-total-count=\"1012\"><em>\u201cOur basic finding is quite startling,\u201d said <a title=\"About Professor Sen\" href=\"http:\/\/scholar.harvard.edu\/msen\">Maya Sen<\/a>, a political scientist at the University of Rochester who conducted the study along with <a title=\"About Professor Glynn\" href=\"http:\/\/www.gov.harvard.edu\/about-department\/faculty-staff-directory\/adam-glynn\">Adam Glynn<\/a>, a government professor at Harvard.<\/em><\/p>\n<p class=\"story-body-text story-content\" style=\"padding-left: 30px;\" data-para-count=\"193\" data-total-count=\"1012\"><em>The standard scholarly debate about how judges decide cases tends to revolve around two factors: law and ideology. \u201cHere, we\u2019ve found evidence that there is a third factor that matters: personal experiences,\u201d Professor Sen said. \u201cThings like having daughters can actually fundamentally change how people view the world, and this, in turn, affects how they decide cases.\u201d<\/em><\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"193\" data-total-count=\"1012\">Among women like me, it&#8217;s generally and fervently believed that we are, collectively, a force for reason and good. It&#8217;s why Emily&#8217;s List, the non-profit that raises money for women&#8217;s political campaigns, has become the default repository for my campaign contributions.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"193\" data-total-count=\"1012\">I want more women in our government. I believe that it&#8217;ll be a group of women who can shame (male) politicians into cutting their NRA leashes and acting on behalf of our contemporary civilization and its citizens by enacting gun control.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"193\" data-total-count=\"1012\">This article and the study it describes gives my beliefs a boost. Hurrah, ladies: you have changed our world for the better, even if it simply involves being your fathers&#8217; daughters.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In
