Massively.<\/p>\n<p>Right now I&#8217;m going to highlight what Kevin Underhill, the maestro of Lowering the Bar, found out about the DEA by reading a Department of Justice report on its own agency&#8217;s performance. Brace yourselves.<\/p>\n<ul>\n<li>The DEA seizes cash and other assets from people it raids or stops&#8211;legitimately and legally or, as it turns out, not.<\/li>\n<li>&#8220;&#8230;<em>in over half the cases there was no discernible connection between the seizure and the advancement of law enforcement efforts<\/em>.&#8221; (Kevin&#8217;s italics, just to emphasize the fact: the DEA is a sort of $$billion$$ criminal enterprise, a theft ring.<\/li>\n<\/ul>\n<p>Let me now point out that Underhill is a lawyer. This means that <em>in over half the cases there was no discernible connection between the seizure and the advancement of law enforcement efforts<\/em>.<\/p><\/blockquote>\n<p><em>Emphasis added.<\/em><\/p>\n<p><em>These aren\u2019t drug seizures we\u2019re talking about, but cash and other assets taken from people who are\u00a0suspected of criminal activity. Not convicted, suspected. Are some of those people actually criminals? Sure! Are they all criminals? Nope. <strong>This concerns some people, \u201cthis\u201d meaning the practice of government officials or agencies taking someone\u2019s property\u2014and often keeping it\u2014without ever proving that person has done something wrong.<\/strong><\/em><\/p>\n<p><em>How often does that happen? Well, nobody knows for sure. Why is that? Well, one problem, according to the report by DOJ\u2019s Inspector General, is that <strong>DOJ \u201cdoes not measure how its asset seizure and forfeiture activities advance criminal investigations.\u201d<\/strong> <strong>Huh.\u00a0Doesn\u2019t it seem like that\u2019s something it ought to do? Keep track of how often it actually had a legitimate reason to take someone\u2019s stuff? Well, it doesn\u2019t<\/strong>. <strong>This, the report opines, \u201crisks creating the impression that \u2026 law enforcement officers prioritize generating forfeiture revenue over dismantling criminal organizations.\u201d<\/strong> Yes there is indeed that risk. Especially because t<strong>here is a\u00a0lot of money being taken this way\u2014according to the report, well over $5 billion between 2007 and 2016.<\/strong><\/em><\/p>\n<div id=\"attachment_38260\" class=\"wp-caption alignright\">\n<p><a title=\"\" href=\"http:\/\/loweringthebar.us5.list-manage.com\/track\/click?u=d34db4689a16c24346a1474e2&amp;id=403ab0f807&amp;e=b27870a939\" rel=\"nofollow\"> <img decoding=\"async\" class=\"size-medium wp-image-38260\" src=\"https:\/\/i0.wp.com\/loweringthebar.net\/wp-content\/uploads\/2017\/04\/war-on-drugz.jpg?resize=300%2C204\" alt=\"\" border=\"0\" \/><\/a><\/p>\n<p class=\"wp-caption-text\">Red=DEA seizures<\/p>\n<\/div>\n<p><em>Since there is no official data, the\u00a0IG\u2019s office looked at a sample of 100 cash seizures by the DEA, which did about 80 percent of the seizing during the relevant time period.\u00a0The sample wasn\u2019t totally random, but was chosen from cases that the IG believed met two criteria making them \u201cparticularly susceptible to civil liberties concerns\u201d: (1) the officer didn\u2019t have a warrant, meaning he or she was (at best) applying his or her own understanding of the Fourth Amendment; and\u00a0(2) the circumstances \u201cseemed to indicate the absence of illicit narcotics,\u201d which I guess means there were\u00a0no drugs and so no direct evidence the person actually was a drug dealer or drug-money courier. In other words, the IG was asking whether, in those cases, does the evidence seem to show there really is a reason for concern?<\/em><\/p>\n<p><em>The answer: yes, if you think that law enforcement should get this right, or at least be able to verify that it got it right, more than 44 percent of the time. Because the DEA could not do that. <strong>In fact, of seizures that took place during \u201cinterdiction\u201d operations\u2014it profiled stopped people while\u00a0traveling\u2014it could verify that doing so had \u201cadvanced or related to a criminal investigation\u201d only 34 percent of the time.<\/strong><\/em><\/p>\n<p><em><strong>Local law enforcement seizes stuff too, and its record is also dismal and often flat-out crooked.<\/strong> The report mentions one incident in Florida where a police task force conducted a money-laundering investigation that resulted in 84 arrests and the seizure of $49 million, of which the police department was allowed to keep more than $6 million. How many indictments resulted? You in the back yelling \u201czero\u201d shut up, you\u2019re ruining it, but yes, <strong>zero<\/strong>. Not one. <strong>\u201cSuch outcomes,\u201d the report tentatively suggests, \u201ccan raise questions about whether seizures are intended to serve legitimate law enforcement interests or to bolster law enforcement budgets.\u201d Yes indeed they can.<\/strong><\/em><\/p>\n<p><em>The report offers a variety of recommendations for improving matters, but can\u2019t quite pull the trigger on the easy and obvious answer: don\u2019t let law enforcement officers or agencies keep any of the money.
