I bet we all catch our breaths when we consider the SCOTUS we’ve been afflicted with and then there was the fear that Justice Kennedy was maybe going to retire last Monday.<\/p>\n

But today I read this in SCOTUSblog and, nutty optimist that I am, my first thought was: Kennedy is staying until 2018! through that huge gerrymander case out of Wisconsin.<\/p>\n

Then I read further and saw Rick Hasen’s comment which affirmed my frantic hopes.<\/p>\n\n\n\n

At NPR<\/a>, Nina Totenberg reports on the debut of Justice Neil Gorsuch, concluding that Gorsuch \u201cis probably even more conservative than the justice he replaced, Antonin Scalia\u201d; she also reports that Gorsuch may soon lose his place as the most junior justice, because \u201cit is unlikely that [Justice Anthony] Kennedy will remain on the court for the full four years of the Trump presidency\u201d: Although Kennedy \u201clong ago hired his law clerks for the coming term, he has not done so for the following term (beginning Oct. 2018), and has let applicants for those positions know he is considering retirement.\u201d At the Election Law Blog<\/a>, Rick Hasen notes that a Kennedy retirement at the end of next term would allow the justice \u201cto go out on a high note, deciding the fate of partisan gerrymandering, gay rights, and who knows what else.\u201d<\/em><\/p>\n<\/div>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n","protected":false},"excerpt":{"rendered":"
