Eloquent, simple and very much worth reading<\/a>. And in its solution to the Judge Cebull problem \u2014 the final lines \u2014 it encapsulates both the strengths and weaknesses of lifetime tenure for Federal judges.<\/p>\n

What can be done when a judge like this one seems not at all to comprehend that by his vile sniggers he’s proclaimed himself unfit for the bench he hangs onto?<\/p>\n

I’ve been thinking: If Cebull somehow keeps his position, anyone involved in a case before him should demand a new judge. It’d be not jury<\/em> nullification but judge<\/em> nullification. Cebull can sit up there without any cases to hear.<\/p>\n

If he doesn’t resign, if he’s not removed, let him preside over a perpetually empty courtroom.<\/p>\n
