NYS judge differentiates pole and lap dances

Judge: Pole Dances Are Artistic Expression, Lap Dances Are Not

Joel Stashenko, New York Law Journal

Pole dance routines by exotic dancers in an Albany-area juice bar are an expression of artistic merit, but the private couch dances performed for individual patrons are not, a state tax department administrative law judge has ruled.

I’m kind of wondering what discovery material the judge used for his decision.

I’m also wondering this monumental decision came from a state tax department administrative law judge.

The things I learn from the New York Law Journal! For one thing, all this pole and lap activity took place in a…juice bar? The judge apparently did not differentiate one juice from another.
